About Sexual Offences

Sexual offences are among the most serious charges in the criminal justice system and are prosecuted under the Sexual Offences Act 2003. The Act covers a broad spectrum of allegations including rape (Section 1), sexual assault (Section 3), and causing a person to engage in sexual activity without consent (Section 4). Separate provisions deal with offences against children, abuse of trust, and the making, possession, and distribution of indecent images of children under the Protection of Children Act 1978 and Section 160 of the Criminal Justice Act 1988.

Sentences for sexual offences are among the heaviest in the criminal calendar. Rape carries a maximum of life imprisonment, with starting points in the sentencing guidelines ranging from five to fifteen years depending on the circumstances. Sexual assault carries up to ten years' imprisonment. Offences involving indecent images carry up to ten years for distribution and up to five years for possession, depending on the category of images involved. Beyond the prison sentence, anyone convicted of a sexual offence is placed on the Sex Offenders Register, subject to notification requirements, and may face a Sexual Harm Prevention Order restricting their activities and movements indefinitely.

The investigation and prosecution of sexual offences has changed significantly in recent years. Historic allegations โ€” sometimes dating back decades โ€” are now routinely investigated and prosecuted. The police and CPS apply specialist guidelines to these cases, and the evidential and public interest thresholds are applied differently to sexual offence cases compared to other crime types. Complainants receive extensive support from specialist officers and independent sexual violence advisors, and the disclosure process is subject to specific protocols.

If you are accused of a sexual offence, the impact on your life is immediate and severe, even before any court proceedings begin. You may be arrested, your devices seized, and bail conditions imposed that restrict your movements and contact with others. Your reputation and relationships are at stake from the moment the allegation is made. Getting specialist representation immediately is not optional โ€” it is the most important decision you will make. The advice you receive before your first police interview, and the strategy adopted from that point forward, will fundamentally shape the outcome of your case.
