Collective Enfranchisement
Helping leaseholders work together to purchase the freehold of their building.
Buying the freehold together
Collective enfranchisement allows qualifying leaseholders to join together to acquire their building’s freehold through the statutory process. It is different from extending an individual flat’s lease.
Establishing eligibility
The building, leases and participating leaseholders need to satisfy the relevant legal requirements. We examine the title and lease documents, the building’s use and the proposed participation before advising on the available route.
Valuation and preparation
A specialist surveyor can advise on the premium and valuation issues. The participating leaseholders also need to agree how the purchase will be organised, funded and managed, including their obligations to one another.
The legal process
Our work can include reviewing eligibility and title, preparing the participation arrangements and notices, dealing with the freeholder’s response, negotiations and the legal documentation for completion. Notices and time limits need careful attention.
